There’s an argument for the justice system to go on site and see what it’s really like for the expert.\u00a0 See\u00a0what he’s got to deal with, and describe and explain to them later.\u00a0 That means judges, juries, and counsel for all parties, also insurance claims managers.\u00a0 It’s messy out there and not at all clean, tidy and precise as\u00a0might be gathered from the\u00a0text books.<\/p>\n
I’ve seen the justice system\u00a0on site\u00a0less than half a dozen times in the years I’ve been investigating engineering failures and accidents.<\/p>\n
I thought of this recently when I was\u00a0examining and measuring conditions on a construction site.\u00a0 I was knee deep in messy, wet pits in the ground and cramped in tiny, grubby crawl spaces.\u00a0 And it was raining off and on too.\u00a0 I was happy though, I was collecting valuable data.<\/p>\n
But how to\u00a0tell the justice system later\u00a0that conditions were different\u00a0from what I expected and more difficult and expensive to quantify?\u00a0\u00a0In this case, less accurate for one element of the problem\u00a0but more\u00a0informative for a second.<\/p>\n
How to describe this in words?\u00a0 I got pictures and this will help.\u00a0 But, seeing is believing.\u00a0 It’s easier if the justice system has seen the conditions.\u00a0 It’s easier then for the expert\u00a0to explain the technical issues arising from\u00a0the conditions associated with the failure or accident.\u00a0 Most of our knowledge is acquired visually – about 80 to 85 percent, so come out and see and understand better what the expert is saying.<\/p>\n
