{"id":626,"date":"2012-10-04T11:18:43","date_gmt":"2012-10-04T11:18:43","guid":{"rendered":"http:\/\/www.ericjorden.com\/blog\/?p=626"},"modified":"2012-10-04T11:18:43","modified_gmt":"2012-10-04T11:18:43","slug":"the-role-of-a-professional-engineer-assisting-counsel-prepare-an-affidavit-of-documents-6th-posting-in-a-series","status":"publish","type":"post","link":"http:\/\/www.ericjorden.com\/blog\/2012\/10\/04\/the-role-of-a-professional-engineer-assisting-counsel-prepare-an-affidavit-of-documents-6th-posting-in-a-series\/","title":{"rendered":"The role of a professional engineer assisting counsel prepare an Affidavit of Documents; 6th posting in a series"},"content":{"rendered":"<p>This is the\u00a06th in a series of postings on the role of a professional engineer in the\u00a011-step\u00a0civil litigation process.<\/p>\n<p>The role of a professional engineer in the preparation of an Affidavit of Documents, the\u00a04th and final step in the Pleadings, is brief &#8211; perhaps three tasks.\u00a0 It involves checking that all relevant technical and scientific documents have been included in the Affidavit.<\/p>\n<p>The Pleadings consist of the following steps in the civil litigation process:<\/p>\n<ul>\n<li>Notice of Claim<\/li>\n<li>Statement of Claim<\/li>\n<li>Statement of Defense<\/li>\n<li><strong>Affidavit of Documents<\/strong><\/li>\n<\/ul>\n<p>An Affidavit is prepared if\u00a0a matter is not settled after the Statement of\u00a0Defense and an exchange of letters in an attempt at a settlement.\u00a0\u00a0An Affidavit of Documents affirms that each party\u2019s relevant documents have been disclosed.\u00a0 All parties prepare, swear, serve and file an Affidavit\u00a0with the court.\u00a0 A party must produce in its Affidavit all documents and electronic information, including technical and scientific material, that it has in its possession or control relevant to the matters in issue.<\/p>\n<p>The role of the professional engineer at this stage of civil litigation might consist of carrying out the\u00a0following tasks:<\/p>\n<ol>\n<li><strong><em>Review Affidavit of Documents of the party who has retained the engineer and confirm that all documents relevant to the technical issues have been considered and included<\/em><\/strong><\/li>\n<li><strong><em>Identify technical documents that should exist and be disclosed by all the parties to the action<\/em><\/strong><\/li>\n<li><strong><em>Assess if an opposing party&#8217;s Affidavit of Documents\u00a0is complete or deficient of documents relevant to the technical\u00a0issues \u00a0<\/em><\/strong><\/li>\n<\/ol>\n<p>&nbsp;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This is the\u00a06th in a series of postings on the role of a professional engineer in the\u00a011-step\u00a0civil litigation process.
